Terms of Service
Last updated: 1 February 2025
These terms of service (“Terms”) govern your use of Clovis and the Career Clinic website at career-clinic.co.uk (“the Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. About the Service
Clovis is an AI-powered tool that provides rubric-based feedback on STAR (Situation, Task, Action, Result) answers for NHS job applications and interviews. The Service is operated by Career Clinic, a sole trader business run by Charlie Winstanley, based in the United Kingdom.
2. Important disclaimer - not professional advice
Clovis provides automated, AI-generated feedback for informational and educational purposes only. It is not a substitute for professional career advice, interview coaching, or employment guidance.
The feedback, scores, and suggested rewrites generated by Clovis are produced by our AI processing platform and are based on general rubrics developed from experience with NHS interview processes. They do not constitute:
- A guarantee or prediction of interview performance or job application outcomes
- Professional career counselling or employment advice
- An official assessment by any NHS body, employer, or recruitment panel
- Legal, medical, or professional advice of any kind
Scores and feedback may be inaccurate, incomplete, or inconsistent. AI models can produce errors, hallucinations, or inappropriate suggestions. You should always use your own professional judgement when preparing job applications and interview answers.
We accept no liability for any decisions you make, or outcomes you experience, based on feedback provided by Clovis.
3. Eligibility
You must be at least 16 years old to use the Service. By using Clovis, you represent that you are at least 16 years of age and have the legal capacity to enter into these Terms.
4. Accounts
You may use some features of Clovis without an account (subject to usage limits). To access your submission history, dashboard, and paid features, you must create an account.
You are responsible for:
- Keeping your login credentials secure
- All activity that occurs under your account
- Notifying us immediately if you suspect unauthorised access to your account
We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.
5. Acceptable use
When using Clovis, you agree not to:
- Submit content that is unlawful, abusive, defamatory, or violates the rights of others
- Include real patient data, confidential NHS information, or other sensitive data that could breach the Data Protection Act 2018 or professional confidentiality obligations
- Use the Service to generate content for fraudulent job applications or to misrepresent your qualifications or experience
- Attempt to circumvent usage limits, reverse-engineer the scoring system, or access other users’ data
- Use automated tools, bots, or scripts to access the Service in a way that exceeds normal usage
- Resell, redistribute, or commercially exploit the Service or its outputs without our written permission
6. Your content
You retain ownership of the STAR answers, job descriptions, and other text you submit to Clovis (“Your Content”). By submitting content, you grant us a limited, non-exclusive licence to process it for the purpose of providing the Service (generating feedback, storing it in your history, and displaying it back to you).
We do not claim ownership of Your Content. We do not sell or share Your Content with third parties for marketing purposes. Your Content is sent to our AI processing provider solely for the purpose of generating feedback, and to a speech-to-text provider solely for the purpose of transcribing voice recordings. These providers do not use your data to train their models.
You are solely responsible for ensuring that Your Content does not contain information that you are not authorised to share, including confidential patient information, classified material, or personal data about third parties without their consent.
7. AI-generated content
Feedback, scores, and suggested rewrites generated by Clovis are AI outputs. You may use these outputs for personal purposes (improving your job applications, preparing for interviews). However:
- AI outputs may contain errors, bias, or inappropriate content
- You should review and edit any AI-generated text before using it in applications
- We do not guarantee the accuracy, quality, or suitability of any AI output
- Submitting AI-generated text verbatim in job applications without review is done at your own risk
8. Subscription plans and pricing
8.1 Free tier
Unregistered and free-tier users receive up to 5 leadership competency reviews per week at no cost. Free-tier access is limited to the leadership competency area only.
8.2 Paid plans
Paid subscriptions (Pro, Max) provide increased usage limits and access to all competency areas. Prices are displayed on our pricing page and are stated in British Pounds (GBP) inclusive of VAT where applicable.
We reserve the right to change pricing at any time. Price changes will not affect your current billing period. You will be notified of price changes before your next renewal.
8.3 Billing
Subscriptions are billed through Stripe. Pro subscriptions are billed weekly. Max subscriptions are billed monthly. Your subscription renews automatically at the end of each billing period unless you cancel.
8.4 Cancellation
You may cancel your subscription at any time through your dashboard (“Manage subscription”) or by contacting us. Cancellation takes effect at the end of your current billing period - you retain access to paid features until then. We do not provide partial refunds for unused portions of a billing period.
8.5 Refunds
Because the Service delivers AI-generated content immediately upon use, we generally do not offer refunds for subscription payments. However, if you believe you have been charged in error or the Service was materially unavailable during your billing period, please contact us at charlie@career-clinic.co.uk and we will review your case. We aim to be fair and reasonable.
9. Coaching services
Career Clinic also offers one-to-one coaching services, which are separate from the Clovis AI tool. Coaching sessions are subject to separate arrangements agreed at the time of booking. Coaching is provided by Charlie Winstanley personally and is not AI-generated.
10. Availability and service levels
We aim to keep Clovis available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Planned maintenance or updates
- Third-party service outages (Anthropic, Supabase, Stripe, Vercel)
- Unforeseen technical issues
We are not liable for any loss or inconvenience caused by temporary unavailability of the Service.
11. Limitation of liability
To the maximum extent permitted by law:
- The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the Service will be error-free, accurate, reliable, or meet your specific requirements.
- In no event shall Career Clinic, Charlie Winstanley, or any of our third-party providers be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of employment opportunities, loss of income, loss of data, or emotional distress, arising from your use of or inability to use the Service.
- Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the total amount you have paid us in the 12 months preceding the claim, or £50, whichever is greater.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
12. Indemnification
You agree to indemnify and hold harmless Career Clinic and Charlie Winstanley from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Content you submit to the Service
- Your violation of any third party’s rights, including confidentiality obligations
13. Intellectual property
The Clovis name, Career Clinic brand, website design, scoring rubrics, and all associated intellectual property are owned by Career Clinic. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.
As stated in Section 6, you retain ownership of Your Content. AI-generated feedback and rewrites are provided for your personal use and are not subject to copyright claims by us.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms. On termination:
- Your right to use the Service ceases immediately
- We may delete your account and associated data after 30 days (except payment records retained for legal obligations)
- Any outstanding subscription payments remain due
You may delete your account at any time by contacting us at charlie@career-clinic.co.uk.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email (if you have an account) or by posting a notice on the website at least 14 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service and cancel your subscription.
16. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or related to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We encourage you to contact us first at charlie@career-clinic.co.uk to resolve any dispute informally before pursuing legal action.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
18. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Career Clinic regarding your use of the Service, and supersede any prior agreements or understandings.
